Terms of Service

1. Acceptance of Terms

By accessing or using the DriverReady platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are agreeing to these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity. If you do not agree to these Terms, do not use the Service.

2. Description of Service

DriverReady is a cloud-based software platform designed to help commercial trucking fleets manage Driver Qualification Files ("DQF") in accordance with FMCSA regulations under 49 CFR Part 391. The Service provides tools for document storage, compliance tracking, expiration alerts, and audit preparation. DriverReady is a software tool — it does not provide legal, regulatory, or compliance consulting services.

3. Eligibility and Account Registration

You must be at least 18 years of age and authorized to operate on behalf of a commercial motor carrier to use the Service. When you register, you agree to provide accurate, current, and complete information. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

4. Subscription, Billing, and Cancellation

DriverReady subscriptions are billed on a month-to-month basis. There are no long-term contracts. You may cancel your subscription at any time by contacting us at hello@driverready.net. Upon cancellation, your access continues through the end of the current billing period. Cancellations are prorated to the date of the request. Partial months are not refunded. DriverReady reserves the right to change pricing with 30 days' advance notice.

5. Permitted Use and Restrictions

You may use the Service solely for the lawful management of Driver Qualification Files for drivers employed by or contracted to your organization. You agree not to:

  • Upload false, misleading, or fabricated documents or driver records.
  • Share your account credentials with unauthorized individuals.
  • Attempt to access data belonging to other DriverReady customers.
  • Use the Service in any manner that violates applicable federal, state, or local laws.
  • Reverse-engineer, decompile, or otherwise attempt to extract the source code of the Service.

You are solely responsible for the accuracy and completeness of data you upload to the Service. DriverReady is a software tool, not a compliance officer. You retain full responsibility for meeting your FMCSA obligations, including maintaining complete and current Driver Qualification Files.

6. Data Ownership and Confidentiality

You retain full ownership of all driver data, documents, and records you upload to the Service. DriverReady does not claim any ownership rights over your data. We will not sell, rent, license, or share your data with third parties except as necessary to provide the Service or as required by law. All customer data is encrypted at rest using AES-256 and in transit using TLS.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. DriverReady does not guarantee that use of the Service will result in successful FMCSA audits, regulatory compliance, or the absence of violations. You are responsible for verifying that your Driver Qualification Files meet all applicable regulatory requirements.

8. Limitation of Liability

To the maximum extent permitted by applicable law, DriverReady LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of the Service. DriverReady's total aggregate liability for any claims arising under these Terms shall not exceed the total fees paid by you to DriverReady in the twelve (12) months immediately preceding the event giving rise to the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless DriverReady LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any data or content you upload to the Service.

10. Termination

Either party may terminate this agreement with 30 days' written notice. DriverReady may terminate your account immediately and without notice if you materially breach these Terms, including but not limited to uploading fraudulent documents, attempting unauthorized access to other accounts, or using the Service for unlawful purposes. Upon termination, your access to the Service will cease. Your data will be retained for 90 days following termination, during which time you may request an export. After 90 days, data may be permanently deleted.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in the State of Delaware, and you consent to the personal jurisdiction of such courts.

12. Changes to Terms

DriverReady reserves the right to modify these Terms at any time. We will notify you of material changes by email or by posting a notice within the Service at least 30 days before the changes take effect. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you may cancel your subscription before the changes take effect.
